Qualifying Conditions for Luxury Decontrol

A rent stabilized apartment can be deregulated if the following criteria are met:

  • The current rent for the apartment is over $2,000
  • The combined annual income of the tenants residing in the apartment is $175,000 or more for the past two years

Luxury Decontrol — Not an Easy Process for Landlords

If the landlord has any reason to believe that the tenant's income is at least $175,000, the landlord can commence a proceeding in court.
